Pursuant to paragraph 20.5 of the Code of Conduct for Persons Licensed by or Registered with the Securities and Futures Commission (Code of Conduct), the following jurisdictions have been determined by the SFC to be comparable OTCD jurisdictions: Australia, Canada, Mainland China, France, Germany, Ireland, Italy, Japan, the Netherlands, Republic of Korea, Singapore, Spain, South Africa, Switzerland, the United Kingdom and the United States of America.
For the purposes of paragraphs 20.2 to 20.4 of the Code of Conduct, the SFC would consider a corporation to be regulated as an OTC derivative dealer or a bank in a way that is similar to the way the OTC derivative dealing activities of a licensed corporation or an authorised financial institution (as case may be) is regulated in Hong Kong if the corporation is regulated, in respect of its OTC derivative dealing activities, in a comparable OTCD jurisdiction by a regulator named below in respect of the jurisdiction:
